O'Donnell v. New Jersey Turnpike Authority, 236 N.J. 335 (2019)- NJ Supreme Court
Mr. Klein successfully petitioned the New Jersey Supreme Court to review the case and successfully argued the matter before the Court. In a favorable decision, the Court reinstated the claims filed by the innocent victims of a tragic motor vehicle crash against the New Jersey Turnpike Authority.
Vizzoni v. B.M.D., 236 N.J. 70 (2018) and 459 N.J. Super. 554 (App. Div. 2019)- NJ Supreme Court and Appellate Division
Mr. Klein successfully moved before the New Jersey Supreme Court for leave to file an interlocutory appeal in this psychiatric malpractice case. The case presented an issue that had not been directly decided in any prior published case in New Jersey. The New Jersey Supreme Court remanded the case to the Appellate Division to be heard. The Appellate Division's decision clarified New Jersey law by holding that the victim of a motor vehicle collision could file a malpractice claim against the psychiatrist who prescribed medication to the driver who caused the crash.
DeLuca v. Tonawanda Coke, 134 A.D.3d 1534 (4th Dep't 2015)- NY Appellate Division
Mr. Klein was the primary author of an extensive appellate brief in this air pollution class action litigation. The Appellate Division's decision sustained the certification of a class action lawsuit consisting of over 38,000 people whose homes were impacted by unlawful air pollution.
In re Expungement of P.H., 436 N.J. Super. 427 (App. Div. 2014)- NJ Appellate Division
Mr. Klein authored the appellate brief in this case-of-first-impression, which clarified New Jersey law regarding the circumstances under which an expungement of criminal charges may be granted.
